- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- PRIMERO. REVOCAR las sentencias proferidas por el Juzgado Promiscuo Municipal de Santo Domingo el día 10 de septiembre de 1992, y por el Juzgado Penal del Circuito de Santo Domingo el 7 de octubre de 1992. En consecuencia se deniega la tutela impetrada y se autoriza proseguir la construcción de la obra que había sido interrumpida.
- SEGUNDO. COMUNIQUESE la presente decisión al Juzgado Promiscuo Municipal de Santo Domingo, y al Juzgado Penal del Circuito de Santo Domingo, para que sea notificada a las partes conforme lo dispone el artículo 36 del Decreto 2591 de 1.991.
