- Primero. REVOCAR los fallos proferidos por el Juzgado
- Segundo. Penal del Circuito de Barranquilla el trece (13) y el catorce (14) de febrero de mil novecientos noventa y siete (1997), al resolver sobre la acción de tutela instaurada por EDILFONSO OROZCO BARROS, contra la Penitenciaría Nacional "El Bosque", del Instituto Nacional Penitenciario y Carcelario, INPEC, y, en su lugar, conceder la protección impetrada.
- Segundo. ORDENAR al Director de la Oficina Jurídica del INPEC que, si ya no lo hubiere hecho, resuelva de fondo, en el término de las cuarenta y ocho horas (48) siguientes, acerca de la solicitud de permiso que ha formulado el accionante.
- Tercero. ENVIENSE copias del expediente y de esta sentencia al Consejo Superior de la Judicatura -Sala Disciplinaria- y al Procurador General de la Nación, para las correspondientes investigaciones.
- Cuarto. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1.991.
