  1. Primero. CONFIRMASE el fallo proferido en el asunto de la referencia por la Corte Suprema de Justicia -Sala de Casación Civil y Agraria- el 5 de diciembre de 1997, pero sólo en cuanto negó la tutela incoada.
  2. Segundo. REVOCASE la mencionada providencia en cuanto sancionó al accionante con multa de diez salarios mínimos mensuales.
  3. Tercero. El Consejo Superior de la Judicatura reintegrará de inmediato la suma pagada por JOSE ALBERTO RAMIREZ PINZON, si al notificarse este fallo ya se hubiere hecho efectiva la multa.
  4. Cuarto. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
