Primero. REVOCAR la sentencia proferida por el Juzgado Promiscuo Municipal de Santa Catalina- Bolívar- En consecuencia, conceder la tutela al derecho al trabajo. Para ello, se le ordenará la Alcalde del Municipio de Santa Catalina, que en el término de cuarenta y ocho horas contadas a partir de la notificación de esta sentencia, se ponga al día con los pagos salariales que debe al señor Luis Miranda Hernández, siempre y cuando cuente con la disponibilidad presupuestal suficiente. En caso contrario, dentro del mismo término, deberá tomar las medidas que permitan atender el pago aquí ordenado. Igualmente, se conmina al Alcalde para que en lo sucesivo, cancele oportunamente los salarios a su trabajador. Lo anterior, con la advertencia de que si incumple la presente orden, se hará acreedor a las sanciones establecidas en el artículo 52 del decreto 2591 de 1991.
Segundo. LÍBRENSE por Secretaria General las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
