- Primero. REVOCAR la sentencia de quince (15) de diciembre de 1997 proferida por el Tribunal Superior del Distrito Judicial de Santa Marta .
- Segundo. CONCEDER la tutela interpuesta. En consecuencia, se ordena al Alcalde Municipal de Fundación - Magdalena la cancelación de los salarios atrasados, si todavía no se ha hecho, en un término máximo de cuarenta y ocho (48) horas siguientes a la notificación de esta Sentencia, con su respectivo reajuste, siempre que exista partida presupuestal disponible. En caso contrario, dentro del término señalado, procederá a iniciar los trámites pertinentes, de todo lo cual informará inmediatamente al juez de instancia.
- Tercero. PREVENIR al Municipio de Fundación - Magdalena para que evite volver a incurrir en las omisiones ilegítimas que originaron el presente proceso, so pena de las sanciones legalmente correspondientes.
- Cuarto. LÍBRENSE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí previstos.
