- Primero. Revocase la sentencia proferida por el Juzgado Doce Penal del Circuito de Medellin, que nego la accion de tutela instaurada por el senor Leon Dario Tobon Orrego, en contra de la Contraloria General de Antioquia. En consecuencia, Concedase el amparo solicitado.
- Segundo. Ordenase al Contralor General de Antioquia o a quien haga sus veces que en el termino de cuarenta y ocho (48) horas contadas a partir de la notificacion de esta providencia, declare la nulidad del fallo 002 de enero 14 de 2003 proferido dentro del proceso fiscal adelantado en contra del senor Leon Dario Tobon Orrego.
- Tercero. Por Secretaria General, librense las comunicaciones a que se refiere el articulo 36 del decreto 2591 de 1991.
