- PRIMERO. REVOCAR la sentencia de la Seccion Tercera de la Sala de lo Contencioso Administrativo del H Consejo de Estado, de fecha 26 de enero de 1996 y, en su lugar, CONFIRMASE la sentencia del 3 de octubre de 1995 dictada por el Tribunal Administrativo del Magdalena.
- SEGUNDO. ORDENAR a la Secretaria General, REMITIR el expediente de tutela al Tribunal Administrativo del Magdalena, para los efectos consagrados en el articulo 36 del decreto 2591 de 1991.
