  1. Primero. REVOCAR las sentencias dictadas por la Sala Primera de Decisión Laboral del Tribunal Superior de Medellín el 15 de agosto de 2001, y por la Sala de Casación Laboral de la Corte Suprema de Justicia el 10 de octubre del mismo año, para en su lugar TUTELAR el derecho fundamental de petición a la accionante GLORIA CECILIA MONTOYA OSORIO, consagrado en el artículo 23 de la Constitución Política.
  2. Segundo. ORDENAR, en consecuencia, al representante del Ministerio de Educación Nacional en el Departamento de Antioquia y a la Oficina Coordinadora del Fondo de Prestaciones del Magisterio en ese departamento, que dentro del término de cuarenta y ocho (48) horas a partir de la notificación de esta providencia y si es que aún no lo han hecho, expidan el acto administrativo que resuelva de fondo la petición presentada por la docente GLORIA CECILIA MONTOYA OSORIO ante la misma oficina regional el 19 de septiembre de 1997 sobre cesantías parciales.
  3. Tercero. ORDENAR que por Secretaría General se dé cumplimiento a lo previsto en el artículo 36 del decreto 2591 de 1991.
