- Primero. REVOCAR la decision proferida por la Sala Laboral del Tribunal Superior de Bucaramanga del 26 de julio de 2000. En su lugar, TUTELAR los derechos fundamentales a la vida y al minimo vital de la senora Maria Laudicis Mejia Vda de Roa.
- Segundo. ORDENAR a la Tesoreria del Departamento de Santander para que en el termino de cuarenta y ocho (48) horas siguientes a la notificacion de este fallo, ponga a disposicion del Instituto de Seguros Sociales, la totalidad del bono pensional necesario para conceder la prestacion social reclamada por la demandante, siempre y cuando cuente con la debida disponibilidad presupuestal.
- En caso contrario, dispondra del mismo termino para iniciar las gestiones tendientes a obtener los recursos necesarios para adelantar el pago del bono pensional tipo B., gestiones y pago que debera agotarse y efectuarse en un plazo maximo de tres (3) meses.
- Tercero. Por Secretaria, librese la comunicacion prevista por el articulo 36 del decreto 2591 de 1991.
