- Primero. REVOCAR la sentencia de 11 de septiembre de 2001, por la cual la Sala de Casación Civil de la Corte Suprema de Justicia revocó la del a quo y denegó el amparo suplicado. En su lugar, TUTELAR los derechos fundamentales al debido proceso y al acceso a la administración de justicia de la demandante.
- Segundo. NEGAR el amparo al derecho a la propiedad por las consideraciones expuestas.
- Tercero. CONFIRMAR la sentencia de 13 de agosto de 2001, proferida por la Sala Civil del Tribunal Superior de Distrito Judicial de Bogotá, D.C., por la cual se ampararon los derechos al debido proceso y al acceso a la administración de justicia dentro de la acción de tutela instaurada por HERMINIA ISABEL BITAR DE MONTES contra la Contraloría General de la República.
- Cuarto. Por Secretaría General, líbrese la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
