- en nombre del Pueblo y por mandato de la Constitución,
- R E S U E L V E :
- Primero. CONFIRMAR la sentencia proferida por el Juzgado Veintiséis (26) Penal del Circuito el 29 de enero de 1993, en el caso de la acción de tutela presentada por LEOPOLDO MARULANDA CASTAÑO como apoderado judicial de ANA LUISA VAHOS y en favor de DARIO DE JESUS GUTIERREZ VAHOS, salvo el aspecto de la indemnización decretada por considerar que no existe daño emergente.
- Segundo. Comuníquese la presente decisión al Despacho Judicial de origen para que sea notificada conforme lo dispone el artículo 36 del Decreto 2591 de 1991.
