Primero. REVOCAR la sentencia proferida por el Juzgado
Cuarto. Civil del Circuito de Tunja. En consecuencia, CONCEDER la tutela por violación del derecho al mínimo vital y al pago oportuno de las mesadas pensionales al señor Alfonso Hurtado Pinzón.
Segundo. ORDENAR a la Caja de Previsión Social de Boyacá, para que en el plazo máximo de cuarenta y ocho (48) horas, contadas a partir de la notificación de la presente decisión, y si aún no lo ha hecho, cancele todas las mesadas pensionales adeudadas al accionante, siempre y cuando haya la disponibilidad presupuestal para ello. De no existir tal disponibilidad, dispondrá del mencionado término par iniciar las gestiones pertinentes a fin de conseguir los recursos para cumplir con el pago aquí ordenado, el cual deberá estar hecho en un plazo máximo de tres (3) meses.
Tercero. Por Secretaría líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
