Primero. Tutelar los derechos a la salud y a la vida digna del señor Pablo Quiñónez Bayona y, en consecuencia, Revocar las sentencias proferidas en el proceso de la referencia por el Juzgado de Menores de Valledupar y por el Tribunal Superior del Distrito Judicial de Valledupar -Sala Civil Familia Laboral.
Segundo. Ordenar al Director de la Penitenciaria Nacional de Valledupar que, si no se ha hecho, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia proceda a efectuar los trámites administrativos necesarios para que le sea practicado al señor Pablo Quiñónez Bayona el examen de Arteriografía de carótida izquierda. Si el correspondiente cuerpo médico determina, a partir de los resultados de dicho examen, que lo procedente es la intervención quirúrgica, ésta deberá ser realizada dentro de los veinte (20) días siguientes a la notificación de esta sentencia. Mientras ello ocurre, deberá suministrarse oportunamente al accionante los medicamentos suficientes y eficaces para controlar el dolor que le produce la lesión tumoral.
Tercero. Por Secretaría General líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991.
