- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- Primero. CONFIRMAR la providencia del veintiséis (26) de julio de 1995, proferida por el Juzgado Unico Laboral del Circuito de Quibdó, pero por las razones expuestas en esta providencia y no por las que sirvieron de base a la providencia que se revisa.
- Segundo. En consecuencia, se DENIEGA la acción de tutela interpuesta por Guillermo Mosquera Dueñas.
- Tercero. ADVERTIR a la administración departamental del Chocó que en adelante, la provisión de cargos deberá realizarse preferentemente mediante concurso público y atendiendo de manera prioritaria a quienes se encuentren inscritos en la lista de elegibles para el correspondiente empleo, según el orden descendente de acuerdo con la puntuación otorgada.
- Cuarto. ORDENAR que por la Secretaría General de esta Corporación, se comunique esta providencia al Juzgado Unico Laboral del Circuito de Quibdó, en la forma y para los efectos previstos en el artículo 36 del decreto 2591 de 1991.
