Primero. REVOCASE la Sentencia del Tribunal Superior del Distrito Judicial de Popayán, del 24 de octubre de 1994, y en su lugar se confirma, por las razones expuestas, la del Juzgado Laboral del Circuito de Popayán, de fecha 8 de septiembre de 1994. En consecuencia, se concede la tutela demandada por el señor ISRAEL MERA GUTIERREZ.
Segundo. ORDENASE al Instituto de Seguros Sociales, Seccional Cauca, que en el término de cuarenta y ocho (48) horas, contado a partir de la notificación de esta Sentencia, proceda a afiliar al señor ISRAEL MERA GUTIERREZ a los mismos seguros y en la misma forma en que se ha hecho o se haga con las madres comunitarias, siempre y cuando el señor Mera Gutiérrez continúe siendo padre comunitario.
Tercero. COMUNIQUESE la presente decisión al Juzgado Laboral del Circuito de Popayán, para que sea notificada a las partes, de conformidad con lo dispuesto en el artículo 36 del decreto 2591 de 1991.
