- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E:
- Primero. REVOCAR la sentencia proferida por el Juzgado 33 Civil del Circuito de Santafé de Bogotá, el 23 de mayo de 2000, y, en su lugar, CONCEDER la protección de los derechos de petición, a la vida en condiciones dignas, a la salud, al mínimo vital, al pago oportuno de la pensión de jubilación.
- Segundo. ORDENAR a la CAJA NACIONAL DE PREVISION SOCIAL, para que, si a la fecha de la notificación de este fallo no ha incluido en nómina al señor Víctor Alfonso Penagos Cerquera, lo haga en el término perentorio e improrrogable de cuarenta y ocho (48) horas a partir de la notificación de la presente providencia, y pague las mesadas adeudadas al mismo, so pena de incurrir en las sanciones que contempla el artículo 52 del decreto 2591 de 1991.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
