  1. Primero. REVOCAR la sentencia proferida el 14 de agosto de 2002 por la Sala Única de Decisión del Tribunal Superior de Pamplona, que denegó la tutela. En su lugar, CONFIRMAR PARCIALMENTE la sentencia de primera instancia proferida del 5 de julio de 2002 por el Juzgado
  2. Primero. Promiscuo de Familia de Pamplona, en cuanto protegió los derechos fundamentales a la igualdad y a la libertad de asociación del señor José Héctor Martín Higuera Peña.
  3. Segundo. MODIFICAR la orden impartida en la sentencia de primera instancia, en el sentido de DEJAR SIN EFECTOS las Resoluciones No. 164 y 165 de abril 29 de 2002 proferidas por el Rector del Instituto Superior de Educación Rural ISER de Pamplona.
  4. En consecuencia ORDENAR, que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente sentencia, el Rector del ISER, autorice el reembolso al señor Higuera Peña de los dineros descontados de su salario, los cuales deberán corresponder al monto indicado por la Pagadora del ISER en documento de fecha 26 de junio de 2002. Igualmente ORDENAR el archivo del proceso disciplinario que se había iniciado en contra del accionante, según Resolución 164 de abril 29 de 2002.
  5. Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
