Primero. REVOCAR los fallos de tutela proferidos por la Sala Laboral de la Corte Suprema de Justicia (expediente T-333882) peticionario Juan Torres De Luque y T-340645, demandante Jaime Ballesteros Campo.
En su lugar, CONCEDER la tutela para la protección de los derechos al trabajo y a la seguridad social, en condiciones dignas y justas, al mínimo vital y a la subsistencia de los mismos.
Segundo. ORDENAR al Alcalde del Municipio de Riohacha que en el término de cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, si no lo hubiere hecho ya, proceda a efectuar las cancelaciones de las mesadas adeudadas a los peticionarios. En caso de no existir los recursos presupuestales suficientes, se concede un lapso de 30 días máximo para que lleve a cabo los trámites presupuestales correspondientes.
Tercero. Por Secretaría General, líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
