Primero. REVOCAR el fallo proferido por el Tribunal Superior de Barranquilla, Sala de Decisión Civil- Familia del 31 de marzo de 2000, y en su lugar CONCEDER la tutela para la protección de los derechos fundamentales de Auristela Córdoba Méndez. En consecuencia, ORDENAR a la Universidad del Atlántico que cancele la mesada pensional del mes de diciembre de 1999 atrasada, -si todavía no lo hubiere hecho -, siempre y cuando exista partida presupuestal disponible, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo. En caso de que no exista la respectiva partida, deberá realizar las operaciones presupuestales para garantizar el pago de la mesada pensional debida. Dichas gestiones no podrán exceder el término perentorio de tres meses.
Segundo. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
