Primero. LEVANTAR la suspensión de términos ordenada mediante auto del ocho (8) de julio de dos mil tres (2003), a fin de adoptar seguidamente la correspondiente decisión.
Segundo. REVOCAR la sentencia proferida el 11 de febrero de 2003 por el Juzgado Veinticinco Civil Municipal de Cali, y en su lugar TUTELAR el derecho a la salud en conexidad con los derechos fundamentales a la vida en condiciones dignas y a la integridad personal de Milton Delgado Camacho.
Tercero. ORDENAR a Coomeva E.P.S. que dentro de las cuarenta y ocho (48) horas siguientes a la notificación del fallo, tome las medidas que sean necesarias para que se practique al joven Milton Delgado Camacho, la cirugía con prótesis modular con suspensión por succión, rodilla monocéntrica y pie sach requerida por Milton Delgado Camacho.
Cuarto. AUTORIZAR a Coomeva E.P.S. para que repita contra el Fosyga por los dineros invertidos en el cumplimiento de este fallo.
Quinto. Por Secretaría líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
