- Primero. Revocar la sentencia del Juzgado
- Primero. Laboral del Circuito de Bogotá, de fecha 16 de julio de 2004, en la acción de tutela presentada por el señor José Otoniel Duque Ramírez contra Cafesalud ARS En su lugar, conceder la tutela en los términos expuestos en la parte motiva de esta providencia.
- Segundo. Ordenar a la ARS Cafesalud, a través de su representante, o quien haga sus veces, que realice en el término de cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, los trámites que correspondan para la inclusión como afiliado del señor Duque Ramírez en la ARS Cafesalud y haga entrega del carné respectivo.
