- Primero. REVOCAR los fallos proferidos por el Juzgado
- Tercero. de Familia de Bogotá, el 13 de febrero de 2001, y por la Sala de Familia del Tribunal Superior de Bogotá, el 23 de mayo de 2001, dentro de la acción de tutela de la referencia. En su lugar, CONCEDER el amparo del derecho fundamental de habeas data.
- Segundo. ORDENAR al representante legal del Banco Granahorrar S.A. que, en el término de cuarenta y ocho (48) horas, disponga lo necesario para que se elimine de las bases de datos de ASOBANCARIA y de cualquier otra central financiera, toda la información relacionada con el crédito del señor Ramírez (No. 550-198-00001784-2) que hubiere sido reportada con posterioridad al 2 de noviembre de 1999.
- Tercero. ADVERTIR al representante legal del Banco Granahorrar, que la anterior información no podrá ser nuevamente registrada, hasta tanto no haya sido atendida de fondo la solicitud de dación en pago formulada por el señor Mario Ramírez el 2 de noviembre de 1999.
- Cuarto. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
