Derecho de petición.
El actor solicitó a la entidad demandada el reconocimiento de su pensión de vejez y hasta la fecha de la presentación de la tutela aun no se había dado respuesta y ya han pasado más de 7 meses.
La corte considera que se han dejado vencer los plazos para responder las peticiones en materia pensional por lo que se ordenará dar respuesta de fondo dentro de los 5 días hábiles siguientes a la notificación de la presente sentencia.

- Primero. REVOCAR la sentencia del veintiocho (28) de julio de dos mil ocho (2008), proferida por el Juzgado Quince Civil del Circuito de Bogotá, y en su lugar CONCEDER la tutela al derecho fundamental de petición del señor Enrique Vargas Colmenares.
- Segundo. ORDENAR al Instituto de Seguros Sociales, que dentro de los cinco (5) días hábiles siguientes a la notificación de esta providencia, si aún no lo ha hecho, se le dé respuesta de fondo a la petición presentada por el señor Enrique Vargas Colmenares, y si se cumplen los requisitos legales, conforme a la jurisprudencia de esta Corte, para este caso, reconozca la pensión de vejez solicitada.
- Tercero. LIBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los fines allí establecidos.
