- Primero. REVOCAR la decision proferida por el Juzgado
- Primero. Civil del Circuito de El Banco, Magdalena (T-242.095), mediante la cual se tutelo el derecho al debido proceso del accionante y en su lugar, denegar la proteccion solicitada.
- Segundo. CONFIRMAR la decision proferida en unica instancia por el Juzgado 25 Penal del Circuito de Santafe de Bogota (T-239989), mediante la cual se denego la proteccion del derecho al debido proceso al accionante, pero por las razones expuestas en la parte motiva de esta Sentencia.
- Tercero. COMPULSAR copia de los expedientes de la referencia a la Fiscalia General de la Nacion para que lleve a cabo las investigaciones de su competencia.
