Primero. REVOCAR la decision de segunda instancia, proferida por la Sala Novena de Decision Laboral, del Tribunal Superior de Medellin, y a su vez, CONFIRMAR la de primera instancia, proferida por el Juzgado
Octavo. Laboral del Circuito de Medellin, por la cual se tutelaron los derechos de los demandantes, con las modificaciones que se establecen en los numerales siguientes.
Segundo. ORDENAR a la empresa SIMESA, proceder, en el improrrogable termino de cuarenta y ocho (48) horas, contadas a partir de la notificacion de esta sentencia, a efectuar los aumentos salariales, a todos los trabajadores pertenecientes a los sindicatos accionantes, en la misma forma en que aparecen establecidos en el pacto colectivo de fecha
Primero. (1deg) de febrero de 1996, sin que para ello sea necesario que renuncien a la organizacion sindical de la cual son miembros.
Tercero. LIBRAR por Secretaria, las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991, para los efectos alli contemplados.
