- Primero. REVOCAR la sentencia proferida por la Sala de Casación Civil y Agraria de la Corte Suprema de Justicia el 18 de agosto de 1999 y, en su lugar, confirmar el fallo adoptado por el Tribunal Superior del Distrito Judicial de Montería el 24 de junio de 1999; en consecuencia, denegar la tutela de los derechos de acceso a la administración de justicia y debido proceso del actor, por las razones expuestas en la parte motiva de esta providencia.
- Segundo. Comunicar este fallo al Consejo Seccional de la Judicatura de Montería para lo de su competencia.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
