- Primero. REVOCAR la sentencia proferida por el Consejo de Estado, Sala de lo Contencioso Administrativo, Seccion Segunda - Subseccion A -, el dia veinticinco (25) de julio de mil novecientos noventa y seis (1996).
- Segundo. CONFIRMAR parcialmente la sentencia proferida por el Tribunal Administrativo de Cundinamarca - Seccion Segunda -, el dia veintiuno (21) de junio de mil novecientos noventa y seis (1996).
- Tercero. CONCEDER la tutela solicitada. En consecuencia se ordena al Alcalde del Municipio de Cogua, ordenar el traslado de la docente Flor Hesminda Orjuela Avila, tan pronto se presente la primera vacante en zona urbana de dicha localidad.
- Cuarto. Se advierte al senor Alcalde del Municipio de Cogua, que el incumplimiento de lo ordenado en esta sentencia se sancionara en la forma prevista por los articulos 52 y 53 del decreto 2591 de 1991.
- Quinto. LIBRENSE, por Secretaria General, las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991, para los efectos alli contemplados.
