- Primero. REVOCAR la sentencia de la Corte Suprema de Justicia, de fecha 8 de agosto de 1996. En consecuencia se tutelan transitoriamente los derechos a la salud, igualdad y trabajo de la señora Berenice Bermúdez Mosquera, hasta que exista pronunciamiento definitivo de la jurisdicción de lo contencioso administrativo, sobre el decreto 61 de 1995, de la Alcaldía del municipio de Coello, departamento del Tolima.
- Segundo. ORDENAR al Alcalde del municipio de Coello, departamento del Tolima, disponer las medidas pertinentes para que la ubicación laboral de la docente no ponga en peligro su salud.
- Tercero. COMUNICAR esta decisión al Tribunal Superior de Ibagué, para que sean notificadas las partes, de conformidad con lo dispuesto en el artículo 36 del decreto 2591 de 1991.
