Revisión oficiosa del Acuerdo de incorporación de Singapur como Estado asociado a la Alianza del Pacífico integrado por la República de Chile, la República de Colombia, los Estados Unidos Mexicanos y la República de Perú con la República de Singapur; y de la Ley 2284 de 2023.
La Corte encontró que en el trámite legislativo de la ley precitada Ley se incurrió en un vicio de carácter insubsanable por la omisión del análisis de impacto fiscal que deben tener las iniciativas legislativas de origen gubernamental.
Concluyó la Sala Plena que las condiciones requeridas para una deliberación adecuada no se encuentran satisfechas cuando la información que el gobierno debe identificar y ordenar no le es presentada al Congreso, lo cual se trata de una actuación que se opone a la racionalidad legislativa esencial, bajo el principio democrático y la democracia deliberativa.
Con base en lo anterior se declaró INEXEQUIBLE la ley estudiada en esta oportunidad.
