Demanda de inconstitucionalidad contra el inciso 4º del artículo 66 de la ley 1098 de 2006, por la cual se expide el Código de la Infancia y la Adolescencia.
El actor considera que la disposición acusada debe ser declarada inexequible por vulnerar los principios constitucionales a la igualdad y al deber del Estado de protección de la familia.
La Corte concluyó que el cuestionamiento planteado por el actor no se refería a la compatibilidad del contenido normativo demandado, sino a problemas que surgirían de hipótesis excepcionales de su aplicación.
La Sala decidió INHIBIRSE de hacer un pronunciamiento de fondo, por ineptitud sustantiva de la demanda.
