Revisión de Constitucionalidad del “Protocolo a la Convención Americana sobre Derechos Humanos, relativo a la abolición de la pena de muerte”, adoptado en Asunción (Paraguay), el 8 de junio de 1990 durante el vigésimo período ordinario de sesiones de la Asamblea General de la OEA y de la Ley 1410 del 13 de septiembre del 2010.
Aprobatorio del mismo.
La Corte encontró un vicio de inconstitucionalidad insubsanable, consistente en que en la aprobación del proyecto de Ley en Senado, el anuncio y la votación tuvieron lugar el mismo día.
En consecuencia, se declara INEXEQUIBLE la Ley 1410 de 2010, aprobatoria del Protocolo a la Convención Americana sobre Derechos Humanos, relativo a la abolición de la pena de muerte.
