en nombre del pueblo y por mandato de la Constitución,
R E S U E L V E :
PRIMERO. ESTESE a lo resuelto en la Sentencia C-231 del veinticinco de mayo de 1995 que declaró exequible el numeral
tercero. del artículo 43 de la Ley 136 de 1994, salvo la expresión "de Educación Superior" que se declaró inexequible.
SEGUNDO. Declarar EXEQUIBLE el artículo 43 de la ley 136 de 1994, desde el punto de vista formal, en la medida en que no se debió haber sometido a los trámites propios para la expedición de las leyes estatutarias, según lo expuesto en la parte motiva de esta providencia.
