Revisión de constitucionalidad del Decreto Legislativo 126 de enero 21 de 2010 “por el cual se dictan disposiciones en materia de inspección, vigilancia y control de lucha contra la corrupción en el Sistema General de Seguridad Social en Salud, se adoptan medidas disciplinarias, penales y se dictan otras disposiciones”.

La Sala declara la inconstitucionalidad por consecuencia del Decreto en cuestión debido a que mediante sentencia C-252 de 2010 se declaró integralmente inexequible el Decreto 4975 de 2009, por el cual el Presidente de la República declaró un “Estado de Emergencia Social”, dicha declaratoria tiene efectos inmediatos y hacía el futuro.Inexequible.
