- Primero. Declarar INEXEQUIBLES las expresiones "Si la víctima no compareciere, se entenderá que desiste de la petición", "excepto" y "casos en los cuales", contenidas en el artículo 15 de la Ley 294 de 1996.
- Segundo. Declarar EXEQUIBLES las expresiones "si la víctima fuere un menor de edad o un discapacitado" y " no podrá haber desistimiento" contenidas en el artículo 15 de la Ley 294 de 1996, en el entendido de que, en los términos de esta sentencia, las víctimas que sean capaces pueden desistir de manera expresa.
