PRIMERO. Declárase INEXEQUIBLE la expresión "en servicio activo o " del inciso 2o del artículo 656 del Decreto 2550 de 1988 por el cual se expide el Nuevo Código Penal Militar.
SEGUNDO. Esta sentencia tiene efectos hacia el futuro y sólo con respecto a los nuevos procesos que den lugar a Consejos Verbales de Guerra y que se inicien a partir de la fecha de su ejecutoria.
