Ley 1280 de 2009, artículos 1 y 2 “por la cual se adiciona el numeral 10 del artículo 57 del Código Sustantivo del Trabajo y se establece la licencia de luto”, los actores consideran vulnerados los artículos 13 y 5 de la Constitución, debido a que ofrece un tratamiento desigual a trabajadores públicos y empleados privados, y desconoce el valor y solidaridad que proporciona una familia para soportar el dolor que genera la perdida de un ser querido.
La Corte concluye que las razones aducidas no constituyen un cargo y por lo tanto decide declararse inhibida para pronunciarse de fondo sobre los apartes acusados.
