Se negó la petición presentada por el ciudadano de la referencia, quien solicitó a la Corte Constitucional, mediante escrito que requiera “al presidente de la Corte Suprema de Justicia para que proceda inmediatamente (en la primera sesión de la Sala Plena de la Corte Suprema de Justicia) a cumplir con sus deberes constitucionales y legales en relación con el fallo”.
Lo anterior, por cuanto ha tenido conocimiento informal, pues la Corte Suprema de Justicia no le ha informado sobre sus actuaciones, de que todavía no se ha cumplido la Sentencia SU.613/02.
La Corte encontró que la negación se debe a sustracción de materia, por lo tanto se presenta un hecho superado.
