- Primero. REVOCAR la decision proferida en segunda instancia por el Juzgado
- Octavo. Civil del circuito de Cali en la tutela interpuesta por la senora LURDES SINISTERRA QUINTANA contra COOMEVA EPS Seccional Cali. En su lugar, se NIEGA la tutela solicitada.
- Segundo. ADVERTIR a la EPS Coomeva, que si ya la intervencion quirurgica solicitada por la accionante ha sido realizada en virtud del cumplimiento del fallo de segunda instancia, se estaria ante un hecho consumado, imposible de retrotraer y del cual no se esperan efectos practicos sobre la vida de la accionante, asi como tampoco que los gastos invertidos en la operacion se reviertan a ella, puesto que segun lo tiene establecido la jurisprudencia los cobros se hacen al Fondo de Solidaridad y Garantias del Sistema General de Seguridad Social en Salud.
- Tercero. LIBRAR la comunicacion de que trata el articulo 36 del Decreto 2591 de 1991.
