Primero. REVOCAR el fallo proferido por el Juzgado
Primero. Penal del Circuito de Santa Marta, del 1deg de marzo de 2001. En su lugar, TUTELAR el derecho al minimo vital del senor Robert Bussy Lobo Guerrero.
Segundo. ORDENAR al Distrito Turistico Cultural e Historico de Santa Marta para que en el termino de cuarenta y ocho (48) horas, contadas a partir de la notificacion de la presente sentencia, si ya no lo hubiere hecho, cancele al demandante los salarios a el adeudados.
Si no dispusiere de los recursos presupuestales suficientes para ello, contara con el termino anteriormente senalado para iniciar las gestiones tendientes a la obtencion de los mismos que le permitan cumplir en su totalidad con el pago de las obligaciones pendientes con el actor, para lo cual dispondra de un plazo maximo de tres (3) meses para ello.
Tercero. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
