Primero. REVOCAR el fallo del Juzgado 1º Laboral del Circuito de Santiago de Cali, de fecha cinco (5) de octubre de mil novecientos noventa y nueve (1999), dictado para resolver sobre la acción de tutela incoada por Janneth Saldarriaga Martínez contra el Hospital San Juan de Dios de Cali y, en consecuencia, conceder la protección de los derechos de la accionante, en especial su mínimo vital.
Segundo. ORDENAR al Director del Hospital San Juan de Dios de Cali, que en el término de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, pague a la accionante todo lo adeudado por concepto de salarios y prestaciones sociales.
El juez 1º Laboral del Circuito de Santiago de Cali velará por el exacto e inmediato cumplimiento de esta providencia.
En caso de desacato, se aplicarán las sanciones previstas en el artículo 52 del Decreto 2591 de 1991.
Tercero. Se compulsarán copias al Juzgado 15 Civil del Circuito de Cali, para que en cumplimiento de sus obligaciones legales y constitucionales, realicen las gestiones necesarias para garantizar la efectividad de los derechos fundamentales de la actora.
Cuarto. Por Secretaría LÍBRESE la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
