Primero. REVOCAR el fallo proferido por Tribunal Superior de Barranquilla, Sala de Decisión de Familia del 11 de febrero del año dos mil, en la tutela instaurada por el señor Orlando Miguel Rojas Guerrero, por las razones expuestas en la parte motiva de esta sentencia y en su defecto TUTELAR el derecho al trabajo y al pago oportuno de salarios del actor.
Segundo. ORDENAR en consecuencia, a la empresa Ingenieros Unidos & Asociados Ltda., cancelar los salarios atrasados al accionante - si todavía no lo hubiere hecho - dentro de las cuarenta y ocho (48) horas siguientes a la existencia de liquidez suficiente para ello. En caso de que no cuente con los recursos necesarios, deberá realizar las operaciones presupuestales para garantizar el pago de los salarios debidos. Dichas gestiones no podrán exceder el término perentorio de cuatro meses.
Tercero. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
