  1. PRIMERO. REVOCAR la sentencia proferida por el Juzgado
  2. Primero. Laboral del Circuito de Barranquilla, del 14 de febrero de 2000, en la tutela instaurada por la señora Marbel Luz Moreno Ruiz, por las razones expuestas en la parte motiva de esta sentencia.
  3. SEGUNDO. ORDENAR en consecuencia, a la E.S.E. Hospital General de Barranquilla cancelar los salarios atrasados -si todavía no lo hubiere hecho- siempre y cuando exista partida presupuestal disponible, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo. En caso de que no exista la respectiva partida, deberá realizar las operaciones presupuestales para garantizar el pago de los salarios debidos. Dichas gestiones no podrán exceder el término perentorio de tres meses.
  4. TERCERO. Por Secretaría líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991.
