- Primero. REVOCAR la sentencia proferida por el Tribunal Superior del Distrito Judicial de Bogotá -Sala Penal-, y la sentencia adoptada por la Corte Suprema de Justicia -Sala Penal-, dentro de la acción de tutela instaurada por Jorge Mora Alvira contra la E.P.S. Instituto de Seguros Sociales por las razones expuestas en la parte motiva de esta sentencia. En su lugar CONCEDER el amparo solicitado.
- Segundo. ORDENAR a la entidad promotora de salud del Instituto de los Seguros Sociales, que dentro de las cuarenta y ocho (48) horas contadas a partir de la notificación de esta providencia, suministre al señor Jorge Mora Alvira el tratamiento que requiera de conformidad con las prescripciones que determine el médico tratante y bajo la continuidad y eficiencia necesaria. Lo anterior, sin perjuicio del derecho que le asiste a la entidad demandada para repetir contra el FOSYGA por los gastos en que pueda incurrir con ocasión del cumplimiento del deber legal y constitucional de protección que aquí quedó claramente estudiado.
- Tercero. INAPLICAR en los términos del art. 4 de la Constitución Política y para el caso concreto, el artículo 61 del Decreto 806 de 1998.
- Cuarto. Por Secretaría General, líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
