- Primero. REVOCAR la sentencia del tres (03) de mayo de 2004, proferida por el Juzgado
- Segundo. Penal del Circuito de la ciudad de Pasto y, en su lugar CONCEDER la tutela de los derechos a la vida, a la salud y a la seguridad social dentro de la acción instaurada por la señora Mireya Melo Melo actuando como agente oficiosa del menor Bryan Camilo Mayac Melo contra el Instituto Departamental de Salud de Nariño.
- Segundo. ORDENAR al Instituto Departamental de Salud de Nariño que, dentro del término de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, se autorice el suministro del medicamento Tegretol, en las dosis y por el tiempo que el médico tratante determine.
- Tercero. LÍBRESE por secretaría la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
