- Primero. REVOCAR la Sentencia proferida por el Juzgado
- Séptimo. Penal Municipal de Barranquilla el 27 (veintisiete) de diciembre de 2001 en la que se decidió no tutelar los derechos invocados por el accionante Samuel Jaimes Labrador.
- Segundo. CONCEDER la protección del derecho a la salud en conexidad con el derecho fundamental a la integridad física de Samuel Jaimes Labrador. En consecuencia, ORDENAR a la E.P.S. Cajanal que en el término de las cuarenta y ocho (48) horas siguientes a la notificación del fallo, disponga lo necesario para que se le practique al accionante la resonancia magnética de columna servical, según la orden de su médico tratante, en los términos señalados en la parte motiva de este fallo.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
