- PRIMERO. INAPLICAR el Decreto 806 de 1998, artículo 10 y la Resolución 5261 de 1994 expedida por el Ministerio de Salud, artículo 18, para el caso concreto y aplicar la Constitución.
- SEGUNDO. REVOCAR el fallo del Juzgado 41 Civil Municipal de fecha 11 de junio de 2002 y en su lugar CONCEDER la tutela impetrada por las razones expuestas en las consideraciones de este fallo.
- TERCERO. ORDENAR a la E.P.S. FAMISANAR LTDA., que en el término de 48 horas, contadas a partir de la notificación de esta providencia, le entregue, si no lo ha hecho ya, el chaleco ortopédico TLSO ordenado por el médico tratante.
- CUARTO. LÍBRENSE por el Juzgado de instancia las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
