- Primero. CONFIRMAR en todas sus partes el fallo proferido por el juzgado 25 Penal Municipal de Medellín, en el trámite de la acción de tutela iniciada por Amparo del Socorro Henao contra el Liceo Santa Elena y la Secretaría de Educación Municipal de Medellín.
- Segundo. La Secretaría de Educación de Medellín, deberá continuar ofreciendo al menor las opciones de estudio desescolarizado que más se adapten a su desarrollo físico y emocional, teniendo en cuenta el sitio donde habita, las posibilidades económicas de su madre y el menor grado de lesividad que cause su comportamiento en la comunidad escolar.
- Tercero. Por Secretaria, LÍBRESE la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
