- PRIMERO. REVOCAR la Sentencia del Juzgado
- Primero. Penal del Circuito de Manizales del 7 de octubre de 2003 y, en su lugar CONCEDER la tutela a la señora María Dolores Londoño Quiceno por la violación a los derechos de vida, seguridad social, integridad personal y al libre desarrollo de la personalidad.
- SEGUNDO. ORDENAR a la Clínica AMAN S.A. de Manizales, fijar la fecha para la realización de un nuevo examen que determine si la cirugía de vesícula es necesaria dentro de un término que no puede exceder de las cuarenta y ocho (48) siguientes a la notificación de esta providencia. Si del resultado de este nuevo examen resulta que subsiste la necesidad de la cirugía, la debe realizar la clínica AMAN S.A. dentro de los diez (10) siguientes al resultado de dicho examen.
- SEGUNDO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
