PRIMERO. REVOCAR la sentencia proferida por el Juzgado Quince Penal del Circuito de Santa Fe de Bogota, por las razones expuestas en esta Sentencia.
SEGUNDO. CONCEDER la tutela solicitada por la Sra. Luz Stella Gutierrez Reyes en representacion de la Sra. Mercedes Reyes de Gutierrez por la vulneracion de los derechos fundamentales a la vida y a la salud al no hacerse efectivo el derecho a la seguridad social.
TERCERO. COMISIONAR al Juzgado Quince Penal Municipal de Santa Fe de Bogota con el fin de que ORDENE al Instituto Colombiano de los Seguros Sociales, en el termino de 48 horas, autorice la cirugia de cambio valvular en la Fundacion Clinica Shaio a la Sra. Mercedes Reyes de Gutierrez y esta le sea practicada en el menor tiempo posible, que no podra ser superior a treinta (30) dias calendario.
CUARTO. COMISIONAR al Juzgado Quince Penal Municipal de Santa Fe de Bogota para que vigile el cumplimiento de la decision tomada en esta sentencia e informe a esta Sala de Revision de la Corte Constitucional al respecto.
QUINTO. A traves de la Secretaria General de la Corte Constitucional, ENVIAR copia de esta Sentencia a la Directora del Instituto Colombiano de Seguros Sociales y al Defensor del Pueblo.
