- R E S U E L V E
- PRIMERO. REVOCAR la sentencia de agosto 10 de 1992, proferida por el Juzgado
- Primero. Civil del Circuito de Santa Marta, que denegó la tutela solicitada por los accionantes.
- SEGUNDO. CONCEDER TRANSITORIAMENTE la tutela solicitada por los señores LUCIO QUINTERO RINCON, JOSE TORREGROSA MERCADO en nombre propio y en representación de la comunidad pesquera de Mendiguaca.
- TERCERO. ORDENAR al propietario o poseedor del predio denominado en este proceso "Playa Rica" o "Pondoro", así como a su beneficiario real, la remoción de cualquier obstáculo físico y psicológico que impida a los habitantes de la zona acceder al mar utilizando el camino carreteable que atraviesa el predio, so pena de incurrir en las sanciones establecidas en los artículos 52 y 53 del Decreto 2591 de 1991.
- CUARTO. ORDENAR al Juzgado
- Primero. Civil del Circuito de Santa Marta ejercer la vigilancia efectiva de lo ordenado en esta providencia e imponer las sanciones respectivas en caso de incumplimiento.
- QUINTO. LIBRESE comunicación al Juzgado
- Primero. Civil del Circuito de Santa Marta con miras a que se surta la notificación de esta providencia, según lo establecido en el artículo 36 del Decreto 2591 de 1991.
